Abode children should not be denied
the right to education

  Recently, mainland children being barred from studying while awaiting court ruling on their abode cases has aroused the attention of the society. Rev. Dominic Chan of the Catholic Diocese urged all Catholic schools to admit these abode children. As a professional teachers' union, we strongly support this call as all educationalists are duty bound to provide education for the next generation.

  In response to Rev. Chan's appeal, however, the Security Bureau issued a directive to schools, warning them that if they admit any of the abode children, they could be committing a crime. But according to the Legislative Councilor, Margaret Ng and the chairman of the Bar Association, Leung Kah-kit, schools that defy the government by admitting abode children cannot be prosecuted.

  Immigration Regulations do stipulate that visitors to Hong Kong have no right to study in schools. But, according to Ms Ng, these children could not be regarded as visitors, since most of them are either illegal immigrants or two-way permit holders who have overstayed. When Cheung Man Kwong and Szeto Wah queried Mrs Fanny Law which criminal code the schools may infringe if they admit abode children, she was not able to provide any answer.

  In fact, the SAR government is accused of breaching two international agreements it has signed on children's rights. Human rights activists say these agreements, including the International Covenant on Economic, Social and Cultural Rights and the Convention of the Rights of the Child, recognize a child's right to education regardless of their legal status. Mr Leung of the Bar Association said, as a signatory to the Convention, China does not deny the right of children staying in the country to receive education. The SAR government should, therefore, also abide by these internationally recognized standards.
Providing education to all children is the duty of all educationists. Szeto Wah, the chairman of the School Management Board of the Grantham Alumni School said his school would do its best to admit these children, some of whom have not had a chance to receive education for up to four years and cannot afford to wait any more.

  Rev. Chan said that for the sake of these children, he would defy government's policy through civil disobedience. The PTU have high respect for Rev Chan and urge all educationists to support him. The PTU will also initiate a signature campaign to support the rights of these children to receive education.


Joint statement:
Right for abode children to receive education

  Receiving education is basic human rights. According to the United Nations' Convention of the Rights of the Child, all children have the rights to receive education. By depriving these abode children of their chance to study, the SAR government has violated their human rights.

  Rev. Dominic Chan of the Catholic Diocese has already sent letters to all Catholic schools and kindergartens urging them to admit these children. We support his call and appeal to all schools to do the same.

  We protest against the position of the SAR Government to deprive abode children of their rights to receive education, which is a breach of international agreement. We hereby submit this joint statement to demand the government to grant these children the rights to education.
