「保守、遲鈍」的詰難

前 言

教協會監事會選戰在即,傳媒引述個別候選人的批評言論,對理事會過去的工作提出質疑,甚或肆意攻擊。身為理事無意猜測發言者是昧於無知,被誤導蒙蔽,抑或別有用心,但是有責任澄清誤解和說明事實。概括而言,這些言論的其中一項「指控」直指教協會「過於保守、反應遲鈍、立場模糊」,本文旨在回應這類「指控」。(理事會對於其他具體指控的回應詳見23/1/2014記者會的〈新聞稿〉)

龐然巨象的教協會

會員逾九萬人的教協會無疑是一個龐大的組織,在教育專業範疇,社會層面以至政治環境中都具有一定的話語權和影響力。教協會立會已四十載,從工作經驗累積以及不斷持續發展而得來的,不僅是有形的資產和潛藏的實力,而更重要的是建立了務實的行事規章,以及凝聚會員的信念、理想和願景。教協會一直堅守鼎足三立的工作方向:發展專業的教育團體、捍衛權益的職工會,以及踐行公義的社會組織。

教協會會員的結構涵蓋前線教師、中層行政人員、領導層的校長、大專院校的講師等,各有不同的處境、難處、需要和期盼;會員年齡層上至年邁的退休人士下及剛出道踏足教壇的年輕伙子,其經歷、識見、價值觀和處事方式千差萬別,對人對事的立場和取態也不盡同。教協會面對的戰場幅面廣闊,觸及學前教育、基礎教育、大專教育和社會教育,問題繁複而焦點散亂;教協會的抗衡和鬥爭對象包括保守力量、建制派、以至本港和內地的當權者,勢力對比懸殊而形勢險惡。因此,教協會處理任何議題必須採取審慎態度,全面的考量和關顧不同會員的憂慮,絕不會草率作決,貿然行事。教協會一直傾向於慎重穩健,以至於後發先至。急於爭取閃亮鎂光的冒進方式,以及不作瓦全的偏激路線從來不是,將來也不該是教協會的處事特色。 …… 閱讀全文

My Understanding on the Rights, Duties and Functions of the Senate

A former Senate member

The election of the Senate will soon take place, and every qualified members shall have the right and duty to vote for the election of its 19 members. Therefore, as a former Senate member, I think it is a right moment to elaborate on the rights, duties and functions of the Senate.

From the perspective of organization, the Annual General Meeting of Members’ Representatives (AGM) is the supreme authority of the union and, subject to this authority the union is governed by the Executive Committee, and safeguarded by the Senate. The AGM is attended by members’ representatives elected from qualified members of the various units of the union, and it shall be held every year. The main business of the AGM is to review the past work of the union and to make plans and policies for the future development.

The conduct of the PTU’s business is vested in the cabinet-like Executive Committee. In the event of only one Proposed Executive Committee being nominated in the election, each qualified member shall case a vote of confidence by secret ballot on one-person-one-vote basis. This means that the elected Executive Committee must obtain votes of confidence of the majority of our members, who support and agree on the visions and missions of the Proposed Executive Committee. Therefore, it is a process of delegating the legitimate power to the Executive Committee for the management of the union business. Moreover, the AGM shall also pass the reports, plans and policies for the future development of the union submitted by the Executive Committee, and the Executive Committee shall be responsible for carrying out the tasks and decisions of the AGM.

The Executive Committee shall hold a weekly regular meeting and a monthly executive committee meeting respectively for the conduct of union daily business and various matters arising from the current social and political development. Work pressure could be expectedly huge when most of our office bearing members who work for the union voluntarily are full-time teachers. To enhance the power legitimacy of and the accountability of the Executive Committee, the Constitution of the HKPTU was therefore amended in the AGM of 1992, in which the Senate was introduced to safeguard the union. The relevant provisions concerning the composition, role and functions of the Senate can be found in rule 8(A) of the Constitution. *

In accordance with (1) in rule 8(A), “……he Senate shall be responsible for making the Executive Committee accountable for its arrangement and conduct of union affairs.” This implies that the Senate supervises and inspects the conduct of the Executive Committee. In the Constitution no provision makes a substantial requirement on how the Senate supervises or inspects the conduct of the Executive Committee, and the Senate shall only safeguard the main directions and principles of the union. Some more substantial requirements in the provisions include “the right to attend Executive Committee Meetings as observers” found in (6) of rule 8(A) and “to demand that the Executive Committee should review its decisions” found in (11) of rule 8(A). However, the execution of this right is not without limit or restriction, which is also stated in the provision (6) and (11) of rule 8(A), where “……not have the right to vote at Executive Committee Meetings” and “……not impose any restrictions on the Executive Committee in the management of union affairs so long as the latter abides by the rules of the union” have respectively demonstrated the balance of power between the Executive Committee and the Senate.

The Senate members attending the Executive Committee Meetings aims at supervising or inspecting whether the office bearers discuss an agenda item or make a decision in accordance with the proper proceedings, and whether a decision thus made coincides with the resolution passed in the AGM or the main objectives of the union. The Senate members also need to ensure that the resolutions made by the Executive Committee have addressed the interest of the majority of our members. Therefore, the Senate members are responsible for advising the Executive Committee on what they have observed, supervised and inspected, and also on whether the resolutions have violated the Constitution or the rule of procedure. So we are neither interfering the Executive Committee, nor participating in the resolution-making process, and we are not absolutely forming another supreme authority in the union. When some of the Senate members, or the whole Senate do not agree on a decision made by the Executive Committee, due to different personal beliefs or values, which however reflects the mainstream thinking of the members and the direction of the representatives of the AGM, the Senate shall have no right to override the resolution. Frankly speaking, in the current Constitution there is no substantial stipulations on the supervisory functions of the Senate. I think that there is still room for improvement and it needs to be thoroughly discussed and reviewed in the future when necessary.

Moreover, with reference to my past experience and observations, something should not be done by the Senate members, like that it is not an appropriate procedure of a Senate member to privately obtain the information of the union affairs from the staff without the Senate’s endorsement. A Senate member should not attend a meeting, where the confidential information of a particular staff member is on the discussion item. And it is not a proper channel of a Senate member to use Facebook as a platform to discuss or criticize the affairs of the Executive Committee. Finally, I would stress that under the Constitutional framework of the union, the Senate has its do’s and don’ts, and the candidates standing for the Senate election should know its essence. Our members should also have more knowledge on the rights, duties and functions of the Senate, and only this could enhance the healthy and stable development of the union.

*(In accordance with the rule 8(A) about the rights, duties and functions of the Senate, including: (1) When the Annual General Meeting of Members’ Representatives is not in session, the Senate shall be responsible for making the Executive Committee accountable for its arrangement and conduct of union affairs. (6) Members of the Senate shall have the right to attend the Executive Committee Meetings as observers and, with the consent of the Executive Committee, to address the meeting. However, members of the Senate shall not have the right to vote at Executive Committee Meetings. (11) The Senate may, when it considers necessary, demand that the Executive Committee should review its decisions. Such demands made by the Senate shall not, however, impose any restrictions on the Executive Committee in the management of union affairs so long as the latter abides by the rules of the union.)

向干預新聞自由的魔掌說「不」
--就商業電台解僱李慧玲小姐的聲明

商業電台「左右大局」節目主持李慧玲小姐,昨天在毫不知情下遭到即時解僱,商台不作任何解釋,甚至不允許李小姐回公司執拾物品,教協會對這種粗暴手法感到震驚和不可思議,正值近日傳媒屢受打壓之際,令人對香港言論自由的前景感到憂心。

一直有傳聞說中央要特首梁振英肩負四大政治任務,要他在任期內完成,包括:23條立法、推動國民教育、執行政改方案及整治包括香港電台在內的新聞自由。

李小姐在今午的記者會中,直言這次事件是梁振英政府的打壓,適逢商台牌照面臨續期,坊間質疑商台解僱李小姐是向政府投降、輸誠,以換取順利續牌。商台昨日表示「君子相分,不出惡言,就中止李慧玲合約一事,商業電台不作任何評論」;政府高層則以「不干預廣播機構人事調動」為由置身事外。教協會認為,商台作為持牌廣播機構,擔當重要的社會責任,當它粗暴解僱一名廣受歡迎、敢言的資深電台主持,而當事人亦表明是受到政治壓力而遭此對待,這就絕不只是李小姐個人的事、不只是一家商業機構的事,它關乎整個整體社會的利益、關乎香港的核心價值。因此,無論商業電台管理層或梁振英政府,都必須就此公開交代,不能以「商業決定」、「人事紛爭」為由來蒙混過關。

新聞自由一直是香港的核心價值,香港人引以為傲。《基本法》第27條訂明,香港居民享有言論和新聞自由。最近,《明報》表示要撤換總編輯,其加東版也一反常態,抽起十多篇專欄。《AM730》和《蘋果日報》也傳出被針對性抽起廣告,廣告商的受壓來源正是特區政府。

這些接二連三的事件表明,這種自由並非必然,它正不斷受到蠶蝕。 傳媒,作為行政、立法、司法三權之外的「第四權」,應該擁有無懼政府壓力及權力干預的道德勇氣和信念,緊守編輯自主和新聞自由,不偏不倚地監察政府施政,以及捍衛社會人權公義等神聖責任。公權力與資本的合謀,運用發牌權力與經濟手段,逼使敢於批評政府的傳媒一一噤聲,進而成為任由政權擺布的工具,令香港的言論空間日漸萎縮,最終受害的是全體社會。

如果我們仍然覺得,炒掉一個人沒什麼大不了、被抽廣告只不過是商業決定、不喜歡就可以抽起專欄,以至封殺別人,香港的自由空間便會被縮小到無力挽救的地步,要尋回失去的新聞自由空間,編採獨立自主,也已經為時已晚,因為,我們失去的,我們將不能承受。

教協會呼籲每一位關心香港的市民,尤其教育界,必須堅定意志,身體力行捍衛新聞自由,向干預新聞自由的魔掌說「不」。

教協會成立「中學行動組」
要求從速檢討教師編制,改善中學教育質素

本港教育生態不斷惡化,無論是中小學,教師課節、課時都過長,加上非教學工作不斷增加,令教師難以集中精神教學。中學方面,形勢更是危急,不單縮班殺校迫在眉睫,令教師疲於奔命,政府推行教育改革,推出新高中學制,師生比例不增反減,教師工作量有增無減。而幾項涉及教師人手的津貼亦將不獲延續,定必令教學環境惡化,最大的受害者肯定是學生。

教協會認為,現時中小學界的教師編制及聘任制度中,存在不少問題,本會及教育界都多次向教育局反映學界實況,要求改善,局方都置若罔聞,令人失望!

本會促請當局成立專責委員會,就改善本港公營學校編制,正式啟動檢討機制,並廣泛諮詢前線教師,公開交代研究結果和理據,確保政府可認真回應教育界和學生在教與學上的實際需求。 …… 閱讀全文

就媒體有關東華學院報導之聯合聲明

早在2014年1月21日,東華學院教協會員關注組發出首次聲明,提出了四項提問與要求,希望東華學院校方於1月31日前作出回應,然而等待近三星期至今,關注組仍然未收到任何來自校方的回應。

有傳媒昨日(2月10日)以頭版刊登題為《東華學院遭舉報違規採購》之報導,引用多份文件及資料,披露東華學院校務委員會主席陳文綺慧女士及副主席黃嘉純先生,涉嫌違反正常招標程序,購買法律服務以修改學院章程。

教協、關注組及學生組織對校務委員會正副主席涉嫌私相授受,黑箱作業之舉動表示極度遺憾,認為相關行為已嚴重影響學院之正常運作與聲譽,為此我們對二人之誠信深表存疑,我們有理由懷疑二人過去就有關學院所作之決策及決定,並非以學院上下之利益為首要考慮。

我們要求兩位涉事人即時停止校務委員會之職務,我們深信清者自清的道理,為了東華學院和三院著想,既然廉署及立法會即將就事件作調查,直至二人之相關調查完結為止。

教協會聲明:關於普通話教中文 坊間的謠言與誤傳

  1. 就有網上言論指教協會支持普通話教中文科,並指前會長司徒華先生及張文光先生支持有關政策。本會特此聲明絕無其事,教協會及兩位前會長從來沒有表達支持立場。
  2. 網上引述張文光於2002年初在教協報《立法焦點》發表的文章,標題是「盡早為普通話教學定位」,內文是發表教授普通話科的意見,並不是提倡普通話教中文科。

教協會對教育局提出幼稚園收生措施的回應

就教育局向立法會教育事務委員會,提交有關「免費幼稚園教育委員會的工作進行」文件,涉及五個範疇的支援措施,當中包括幼稚園收生的安排,當局表示有計劃於2015-16學年入讀幼兒班(K1)的學生,須以「學券」作為確認學位的文件,實行「一券一位」,並有意由早前提出只於北區、屯門、元朗和大埔等4區推行,擴至成為全港性的措施。

會長馮偉華及教協立法會議員葉建源,對當局在短時間內提出涉及全港幼稚園的收生措施,提出意見如下:

1. 從長計議:幼稚園一生一位的政策剛在北區試行,尚有不少有待改進的地方,而除了北區、屯門、元朗和大埔區外,其他地區面對的問題未必相同,尤其是學位仍未緊張的地區,由於家長註冊後仍可以取回學券報讀其他學校,因此,以學券方式留位,能否在各區發揮同等效用,仍有待商榷。因此,當局必須經周詳考慮提出具體方案,並回應業界的憂慮,例如業界質疑方案無約束力等。 …… 閱讀全文
