上一期的專欄本部說明了教育局就有關「解僱程序」在《資助學校資助則例》中所作的變動,今期則闡述關於「停職支薪安排」的修訂。
《資助則例》(1994年9月)訂明,校董會可根據《僱傭條例》的規定,對教師或校長作出停職的安排,適用的情況如下:
i. in case where criminal proceedings of a serious nature have been, or are likely to be instituted;
ii. in case where the teacher’s serious misconduct is under investigation and it would be against the interest of the school for him to continue to teacher in the classroom.
In case of (i), where the criminal proceedings are not concluded within 14 days, the period of suspension on half pay may be extended till the end of such proceedings. The School Management Committee may decide whether or not to suspend the teacher on half pay and such payment of salaries shall be subject to the approval of the Permanent Secretary.
《資助則例》(1994年9月)表明教師或校長因上述原因被校方安排停職期間,在常任秘書長批准下仍可支取半薪。
